| The NETS FlashPay Pilot Launch “Ride &
Redeem” Promotion (the “Promotion”) is organized
by NETWORK FOR ELECTRONIC TRANSFERS (SINGAPORE) PTE LTD ("NETS"). |
Eligibility & Conduct of Promotion |
| 1. |
Any individual who pays using the NETS FlashPay
on buses, MRT and LRT shall be eligible to participate in the
“Ride & Redeem” (“the Participant”). |

|
| 2. |
The qualifying period of the Promotion is from
19 August 2009 to 25 September 2009 (both dates inclusive) (the
“Qualifying Period”) or such other period as may
be determined by NETS in its absolute discretion. |
| |
|
| 3. |
To participate for the Promotion, |
| |
- A Participant will need to SMS in the following message
format to 8288 8400 from 19 August 2009 to 25 September
2009 (both dates inclusive):

| 4. |
All details and particulars submitted on the
SMS must be true, accurate and complete. |
| |
|
| 5. |
Incorrect or incomplete SMS entry for the Promotion
will be disqualified. NETS will not be responsible for incomplete,
lost, late, damaged or misdirected SMS entry. |
| |
|
| Conduct of Draw |
| 6. |
Only payments for rides on buses, MRT and LRT
using the NETS FlashPay during the Qualifying Period will be
eligible. The following transactions will be excluded: |

- Top-up services
- • Transactions relating to or in respect of any
retail purchase and/or payments for any goods and services
which are carried out or made outside buses, MRT and LRT

| |
|
| 7. |
If NETS subsequently discovers or determines
in its absolute discretion that a participant is not entitled
to or is disqualified to participate in the Promotion, NETS
may at its sole discretion do any of the following: |
| |
- forfeit the Twenty Singapore Dollar (S$20) shopping vouchers
; and/or
- reclaim the Twenty Singapore Dollar (S$20) shopping vouchers
from the participant and select another participant who
qualifies.

| 8. |
There will be a total of 8,000 Twenty Singapore
Dollar (S$20) shopping vouchers to be redeemed for each eligible
participant. |
| |
|
| 9. |
The NETS FlashPay card, the winning SMS notification
and NRIC must be produced to claim the Twenty Singapore Dollars
(S$20) shopping vouchers at:
NETS Sales & Customer Service Centre, 298 Tiong Bahru Road
#02-03/06, Central Plaza, Singapore 168730 (Operating Hours:
8.30am to 5.30pm (Mondays to Fridays) 8.30am to 12.30pm (Saturdays).
We are closed on Sundays and Public Holidays)
Period for claiming of prize: 5 October 2009 to 4 November 2009 |

| 10. |
NETS shall determine in its absolute discretion
the mode and manner for the SMS entry in the “Ride &
Redeem”. A Participant will stand a chance to redeem the
Twenty Singapore Dollars (S$20) shopping vouchers by being the
1st 8,000 participants to accumulate a minimum of 60 rides in
the “Ride & Redeem” and the Participant shall
accept the prize “as is, where is”. There shall
be no replacement for loss of prize after receipt / collection
of the prize.

The 1st 8,000 participants who fulfilled the minimum
60 rides using the NETS FlashPay will be eligible to redeem
for the Twenty Singapore Dollars (S$20) shopping vouchers. |

| 12. |
The winner shall be notified by SMS, and no other
notifications will be made by NETS. |
| |
|
| 13. |
NETS, NETS’ authorized agencies, sponsors,
organizations and the directors, officers, employees and assignee
thereof (collectively the “Indemnified Persons”)
shall not be liable in any way for any claim, loss, injury,
damage or inconvenience (a) arising in connection with the Promotion,
including any error in computing the number of rides, any breakdown
or malfunction in any computer system or equipment, any notice
which is misdirected or lost in the post; or (b) suffered or
incurred by a Participant, the winner or any other person howsoever
arising in connection with the Promotion. Each Participant in
the Promotion (including his or her heirs executors and/or administrators)
hereby agrees to indemnify and hold each of Indemnified Persons
harmless from and against any and all claim, loss or damage
that may be suffered by the Participant in relation to the Promotion
or any prize and shall release and discharge each of the Indemnified
Persons completely from any and all claims, liabilities, judgments,
suits, proceedings, actions and all costs (including solicitor
and client costs), expenses, penalties, fines or fees brought
by or against the Participant. |

| 14. |
Neither NETS nor its authorized agencies and
any sponsor or organization associated with the Promotion shall
be held liable for any failure or omission to carry out the
Promotion in accordance with these terms and conditions or for
any loss or damage suffered by the Participants if such failure,
omission, loss or damage arises out of or in connection with
any event of force majeure, including without limitation any
calamity or conditions, acts of God or warlike hostilities,
civil commotion, riots, blockades, embargoes, sabotages, strikes,
fires, lockouts, shortages of material or labour, terrorist
activity, epidemic, health risk or any defect, failure, interruption,
breakdown or malfunction of any machine, computer system, data
processing system or transmission link, or any other occurrence
beyond the reasonable control of NETS, its authorized agencies
and any sponsor or organization associated with the Promotion,
as the case may be. |

| 15. |
NETS' decision on all matters relating to or
in connection with the Promotion shall be at its sole and absolute
discretion and shall be final and binding on all Participants.
Except for the notification of the winners by mail/phone, NETS
shall not be obliged to enter into any correspondence on any
matter concerning the Promotion. In the event of any inconsistency
between these Terms & Conditions and any brochure, marketing
or promotional material relating to the Promotion, these Terms
& Conditions shall prevail. |

| 16. |
Prizes are not transferable or exchangeable for
cash, credit or any other items. NETS may at its sole discretion
at any time and without prior notice replace or substitute a
prize with another prize of similar value selected by NETS.
NETS makes no representations or warranties as to the quality/suitability/merchantability
of any of the goods/services offered as prizes. NETS is not
liable for any loss, damage or injury suffered or sustained,
to person or property and including, but not limited to, indirect
and consequential (including economic) losses by reason of the
use, enjoyment or operation of any prize by a Participant, his
family or any other person. |

| 17. |
NETS shall not be liable in any way for any loss
or damage arising in connection with the Promotion, including
but not limited to problems or any breakdown or malfunction
of any computer system or equipment, software, any telephone
network or lines, servers or providers or any combination thereof.

|
| 18. |
If for any reason the Promotion is not capable
of running as planned (including and not limited to) infection
by computer virus, tampering, unauthorized intervention, fraud,
technical failures or any other causes beyond the control of
NETS which corrupt or affect the administration, operation,
security, fairness, integrity or proper conduct of the Promotion,
NETS reserve the right in its sole discretion to disqualify
any Participant who tampers with the entry process and to cancel,
terminate, modify or suspend the Promotion. |

| 19. |
By participating in the Promotion, the Participants
shall be automatically granted an immediate NETS Membership
and shall enjoy the privileges accorded to a NETS member. Participants
shall be deemed to have read, understood and agreed to be bound
by the Terms and Conditions Governing NETS Membership, copies
of which are available at www.nets.com.sg. |

| 20. |
By filling in their personal particulars in the
SMS entry the Participants shall be deemed to have agreed to
the use, publication and disclosure by NETS of their personal
particulars (including their names, identification/passport
numbers and photographs) in connection with their participation
in the Promotion and the NETS Membership. |

|
| 21. |
NETS reserve the right to disclose and publish
the name, and such other particulars (including the photograph)
of any Participant/winner in such mode and manner as NETS may
in its sole discretion deem appropriate for publicity purposes
and the winner agrees to be photographed, the disclosure of
his or her personal particulars, the use of his or her name,
picture, image and voice for publicity purposes connected with
the promotion and to co-operate with and participate in the
activities organized by NETS for this purpose without additional
compensation. |

| 22. |
NETS reserve the right at its absolute discretion
to terminate the Promotion or vary, delete, add to any of these
Terms and Conditions from time to time without prior notice
including without limitation the date of the promotion. |

| 23. |
These Terms and Conditions shall be governed
by the laws of Singapore and the Participants irrevocably submit
to the non-exclusive jurisdiction of the Courts of Singapore. |
| |
|
| 24. |
A person who is not a party to any agreement governed
by these Terms and Conditions shall have no rights under the
Contracts (Rights of Third Parties) Act (Cap 53) to enforce
any provision of these Terms and Conditions. |
| |
|
| 25. |
Submission of the SMS entry by a Participant signifies
his or her acceptance of the Terms and Conditions stated above. |
