“NETS FlashPay Pilot Launch” Lucky Draw
Terms and Conditions
Updated as at 18 August 2009
 
The “NETS FlashPay Pilot Launch” Lucky Draw (“Lucky Draw”) is organized by NETWORK FOR ELECTRONIC TRANSFERS (SINGAPORE) PTE LTD ("NETS").

Eligibility
1. Any individual who pays using the NETS FlashPay shall be eligible to participate in the Lucky Draw (“the Participant”).
     
2. Employees of NETS and their immediate family members are not eligible to participate in the Lucky Draw.
   
3. The qualifying period for the Lucky Draw is from 19 August 2009 to 25 September 2009 (both dates inclusive) (the “Qualifying Period”) or such other period as may be determined by NETS in its absolute discretion.
   
   
4. Each NETS FlashPay transaction with no minimum spent requirement, will entitle the participant to one (1) lucky draw chance. The number of chances allocated to a Participant by NETS is binding and conclusive on the Participant and chances awarded to the Participant are not transferable or to be combined with chances awarded to any other Participant. NETS is not obliged to notify a Participant of the number of chances awarded to him or her and no correspondence or communication on this matter will be entertained. Should the NETS FlashPay be suspended, cancelled or terminated at any time up to date of the claiming of the prize or the FlashPay transaction be revoked or cancelled due to refund or otherwise or the NETS FlashPay has lapsed or expired up to the date of the claiming of the prize, NETS shall cancel all chances accumulated to that NETS FlashPay without incurring any liability.
   
5. If NETS subsequently discovers or determines in its absolute discretion that the winner is not entitled to or is disqualified to participate in the Lucky Draw, NETS may at its sole discretion do any of the following:
  5.1 forfeit the prize; and/or
  5.2 reclaim the prize from the winner and select another winner.
   
Conduct of Draw
6. There will be only one (1) draw conducted and a total of fifty (50) winners.
   
   
7. The fifty (50) winners will be picked on 16 October 2009.
   
8. The fifty (50) winners will each win One hundred Singapore Dollars (S$100) Robinsons Vouchers.

The draw will be conducted at NETS’ office at 298 Tiong Bahru Road, #04-01/06 Central Plaza, Singapore 168730 or such other venue as may be determined by NETS and it is not open to the public. NETS reserves the right to change the draw date(s) at its sole discretion. The winner will be selected at random by means of a computerized system during the draw. NETS’ decision as to the winner of the draw shall be final and conclusive. At the draw, NETS may draw reserve “winners” to replace any winner subsequently disqualified.
   
9. All winners shall be notified by phone. All winners must be contactable within 3 call attempts for NETS to obtain their full particulars. In the event that NETS is unable to contact the winner within this period, NETS will choose another winner. The results of the draw will be announced on the Website after the draw. NETS' decision shall be final and no correspondence will be entertained.
   
10. The prize shall be claimed by the winner in person at the NETS Customer Service Centre, 298 Tiong Bahru Road #02-03 Central Plaza Singapore 168730 within two (2) months after the date of draw. If the prize remains unclaimed after this period, it shall be forfeited without liability on the part of NETS to the winner and be donated to a charitable organization of NETS' choice.

11. The winner must produce his NETS FlashPay, NRIC, Work Permit or Foreign Identification Document when he claims his prize, failing which NETS has the right to disqualify the winner.
   
12. Each prize winner agrees to co-operate with and participate in any advertising or publicity activities of NETS relating to the Draw and agrees that NETS may publicize the name, IC/passport number and/or photograph of any Winner in such mode and manner as NETS considers fit.
   
13. NETS reserves the right to disclose and publish the name, and such other particulars (including the photograph) of any winner in such mode and manner as NETS may in its sole discretion deem appropriate for publicity purposes and the winner agrees to be photographed, the disclosure of his personal particulars, the use of his or her name, picture, image and voice for publicity purposes connected with the Lucky Draw and to co-operate with and participate in the activities organized by NETS for this purpose without additional compensation.
   
Additional Terms & Conditions
14. By entry in the Lucky Draw, participants shall be automatically granted an immediate NETS Membership and shall enjoy the privileges accorded to a NETS member. Participants shall be deemed to have read, understood and agreed to be bound by the Terms and Conditions Governing NETS Membership Terms & Conditions, copies of which are available at www.nets.com.sg. Participants shall be deemed to have agreed to the use, publication and disclosure by NETS of their personal particulars (including their names, identification/passport numbers and photographs) in connection with their participation in the Lucky Draw and the NETS Membership.
   
15. Prizes are not transferable or exchangeable for cash, credit or any other items. NETS may at its sole discretion at any time and without prior notice replace or substitute the prize with another prize of similar value selected by NETS.
   
16. If a prize remains unclaimed by the winner after 15 December 2009, the winner shall be deemed to have forfeited the prize notwithstanding non-receipt of notification from NETS and NETS shall have no liability for or in respect of any claim made by the winner. NETS reserve the sole discretion and right to do whatever it deems fit to the forfeited prize.
   
17. NETS, NETS’ authorized agencies, sponsors, organizations and the directors, officers, employees and assignee thereof (collectively the “Indemnified Persons”) shall not be liable in any way for any claim, loss, injury, damage or inconvenience (a) arising in connection with the draw, including any error in computing any Lucky Draw chance, any breakdown or malfunction in any computer system or equipment, any notice which is misdirected or lost in the post; or (b) suffered or incurred by a Participant, the winner or any other person howsoever arising in connection with the Lucky Draw. Each Participant in the Lucky Draw and the winner (including his or her heirs executors and/or administrators) hereby agrees to indemnify and hold each of Indemnified Persons harmless from and against any and all claim, loss or damage that may be suffered by the Participant or the winner in relation to the Lucky Draw or any prize and shall release and discharge each of the Indemnified Persons completely from any and all claims, liabilities, judgments, suits, proceedings, actions and all costs (including solicitor and client costs), expenses, penalties, fines or fees brought by or against the Participant or the winner.
   
18. Neither NETS nor its authorized agencies and any sponsor or organization associated with the Lucky Draw shall be held liable for any failure or omission to carry out the Lucky Draw and/or the draw in accordance with these terms and conditions or for any loss or damage suffered by the Participants if such failure, omission, loss or damage arises out of or in connection with any event of force majeure, including without limitation any calamity or conditions, acts of God or warlike hostilities, civil commotion, riots, blockades, embargoes, sabotages, strikes, fires, lockouts, shortages of material or labour, terrorist activity, epidemic, health risk or any defect, failure, interruption, breakdown or malfunction of any machine, computer system, data processing system or transmission link, or any other occurrence beyond the reasonable control of NETS, its authorized agencies and any sponsor or organization associated with the Lucky Draw, as the case may be.
   
19. NETS' decision on all matters relating to or in connection with the “NETS FlashPay Pilot Launch” Lucky Draw (including the draw chances awarded to a Participant and the selection of the winner of the draw) shall be at its sole and absolute discretion and shall be final and binding on all Participants. Except for the notification of the winner by mail and/or phone, NETS shall not be obliged to enter into any correspondence on any matter concerning the Lucky Draw. In the event of any inconsistency between these Terms & Conditions and any brochure, marketing or promotional material relating to the Lucky Draw, these Terms & Conditions shall prevail.
   
20. NETS reserve the right at its absolute discretion to terminate the Lucky Draw or vary, delete, add to any of these Terms and Conditions from time to time without notice including without limitation the basis of awarding the draw chances, the number of draw chances awarded and the date of the draw.
   
21. These Terms and Conditions shall be governed by the laws of Singapore and the Participants irrevocably submit to the non-exclusive jurisdiction of the Courts of Singapore.
   
22. A person who is not a party to any agreement governed by these Terms and Conditions has no rights under the Contracts (Rights of Third Parties) Act (Cap 53) to enforce any provision of these Terms and Conditions.
